Details on the list of goods and services


When creating lists of goods and services, there are certain requirements that you must take into account. Here you can read what you should pay particular attention to.

Create directories - avoid complaints

Goods and services that are to be labeled with a brand must be specifically named - the Specification of pure class numbers (like "12, 22, 36") is not enough. Goods and services must be precisely named in lists so that the scope of protection of a trademark can be defined in a later dispute. "Not sufficiently defined" are general terms such as "machines" or "systems". If you use vague terms, the registration process can be considerably delayed.

In order to avoid complaints about the list of goods and services, you should create it directly from the standardized classification database (TMclass). For details, please refer to the Instructions for use (0.96 MB).

For registrations in paper form, please use the corresponding field in the registration form to create the list of goods and services; If the space provided there is not enough, you can add additional pages as an attachment. Please note that extensive lists of goods and services lead to increased testing effort and thus significantly longer processing times. Therefore, if possible, use the Group title of the eKDB to avoid overly long directories.
In addition, the more goods and / or service classes you claim, the more likely it is that you will object to the registration of your trademark.

Grouping compulsion

Goods and services must be separated into classes and the classes listed in numerical ascending order, for example:

Class 3: Cosmetics; cosmetic bath additives;
Class 5: Pharmaceutical products; Medicines for dental purposes;
Class 44: Hygienic and beauty care for humans and animals.

Ungrouped lists of goods and services can delay processing considerably. If no grouped directory is submitted, this can lead to the complete rejection of the registration.

Leading class

You can suggest one of the claimed classes as the leading class. The leading class should reflect the economic focus of the goods and / or services for which the trademark is to be used. Your lead class proposal is not binding for the DPMA, but it will usually be taken into account. The leading class determines which trademark unit is responsible for processing the application.


The amount of the fees to be paid can be found in the summary of your web registration or the confirmation of receipt. The amount of the fee consists of the basic registration fee for up to three classes and possible class fees.

The fees are to be paid in the amount shown within three months of submitting the application. If the DPMA does not receive the basic registration fee on time, your application is deemed to be withdrawn. If class fees are not paid in full in due time, the leading class and then the following classes are taken into account in the order in which they are allocated if it has not been determined within the deadline set for subsequent payment which classes are to be covered by the fee paid. For the classes that have not been paid for, the registration is deemed to be withdrawn.

If, in the case of free-form lists of goods and services, it is found that additional chargeable goods / service classes have arisen, for example because goods have been assigned to an incorrect class that belongs to a different class that has not yet been listed, you will be informed of this and the corresponding class fees. You can then decide whether to pay them or forego goods and / or services.
