GENERAL RENTAL TERMS
Posarelli Villas GB LIMITED (hereinafter referred to as Posarelli) with its registered office at Royston Road, Duxford, Cambridgeshire CB22 4QH, company number 05906789, acts as a representative without power of representation (in its own name).
DIMORE SRL, based in Via Montegufoni 20-50025 Montespertoli FI (hereinafter referred to as Dimore) is the local representative of Posarelli and customer service for Italy, Spain, Greece and Crete.
Posarelli is authorized to act as an intermediary in the name and on behalf of the property owners.
The minimum rental period is usually one week from Saturday to Saturday, however, in certain accommodations, stays with different arrival and departure days than Saturday can be booked. In this case, the minimum stay can be less than a week. You can find this information in the price list of each individual property.
Booking fees € 30 / per booking.
2) PRICE LIST
The stated rental prices are broken down into seasons and apply per unit and week, from Saturday to Saturday (exceptions are listed in the property description) or per night (if stays of less than a week are accepted). All additional costs (indicated in the description of the individual properties) are not included in the rental price and must be paid directly to the owner or his representative on arrival, unless otherwise agreed in writing at the time of booking. Rental prices are an integral part of these general rental conditions; The agencies or operators are not authorized to change the rental prices in any way.
2A) LOWEST PRICE GUARANTEE
Posarelli Villas / Dimore guarantees that the prices published on their own price lists are the lowest that can be found on the market. If the customer finds lower prices (in the same period, on the same terms, in euro prices) he can communicate this and has the right to receive a discount from Posarelli Villas / Dimore and the same price that the customer found at the competition (on the same terms as mentioned above).
An exception is the possibility of finding a lower price of up to 50 euros on the published prices (always under the conditions mentioned above). The price difference is not taken into account here.
3) RENTAL TERMS
All reservations must be made directly with Posarelli or through the representative agencies on behalf of and on behalf of Posarelli. Agents can also receive payments in the name and on behalf of Posarelli. To complete a reservation, the vacationer must fill out the booking form and accept the general rental conditions.
At the time of booking, the holidaymaker must pay 25% of the total rental price + 30 euros as a booking fee as a deposit. The balance must be received by Posarelli within 60 days of the start date. If these conditions are not paid, Posarelli reserves the right to cancel the booking. If the rental contract is concluded within 60 days before the start of the rental period, the customer must pay 100% of the total rental price at the moment of the reservation. For some structures of our program, different payment conditions apply than those described above and which you can find in the presentation of the selected accommodation.
After receiving the balance, Posarelli will send the holiday guest the voucher with directions to the rented property, the address and all useful information. Upon arrival, the guest must present the voucher to the owner or his representative. No other document than the voucher issued by Posarelli entitles the guest to move into the holiday accommodation. This document is nominal and cannot therefore be transferred to third parties. The owner or his representative can request the immediate removal of guests if their number exceeds the maximum number indicated on the voucher. Any change in the total number of people during the stay must be notified to Posarelli in advance in writing, otherwise the owner or his representative may request the removal of the entire group. In this case, the guest's request for compensation and / or reimbursement cannot be accepted
Any changes and special requests must be communicated to Posarelli and accepted by Posarelli.
Posarelli or Dimore reserve the right to impose a reasonable administration fee and any related costs imposed by the owners due to special requests or changes.
Unless otherwise stated in the property description, children under 2 years of age can stay in the accommodations free of charge and are not counted in the number of vacationers, provided that the parents bring the cot and the necessary linen with them.
4) METHOD OF PAYMENT
Payments must be made by bank transfer or credit card (VISA or MASTERCARD or AMEX). In the case of payment by bank transfer, the name of the guest, the reservation number and the reference code of the rented property must be given. Leases that do not comply with these payment methods will not be considered valid. Payments in currencies other than EUR will not be accepted.
5) ARRIVAL AND DEPARTURE
The holiday guest must arrive at the accommodation between 5:00 p.m. and 8:00 p.m. (unless otherwise stated in the property description and / or in the voucher). Any change in times must be communicated to Poararelli during office hours (Monday to Friday from 9:00 a.m. to 1:00 p.m. and from 2:00 p.m. to 6:00 p.m. and from Easter to October on Saturday from 4:00 p.m. to 8:00 p.m.) and must be approved by the owner prior to arrival. In the event of an unexpected delay on the day of arrival, the guest must call the owner or Posarelli (phone number can be found on the voucher). In the event that the owner or his representative cannot accept a late arrival, all costs for meals, accommodation, travel and other expenses must be borne by the guest. The owner or his representative, who should be forced to wait on site after the agreed time, can ask the guest to reimburse the costs. Upon arrival, the guest must present to the owner or his representative the voucher and the identity documents of all persons present in order to allow registration with the competent authorities, as required by Italian law. Only people whose presence has been registered with the competent authorities can stay on the property. In the event of an unannounced exchange of people during the rental period, the owner or his representative can request the immediate removal of the guest. In this case, no compensation and / or refund can be paid to the guest. In addition, any additional fees not included in the rental price and payable on site can be deducted from the deposit.
The departure must take place between 8:00 am and 10:00 am (unless otherwise stated in the description of the property and / or on the voucher) so that the keys can be returned to the owner or his representative. The owner has the right to check the rental property for completeness and damage.
Upon arrival, the guest must pay a deposit to the owner or his representative to guarantee compliance with the general rental conditions and payment of any costs for damage and / or additional costs not included in the rental price.
The deposit must be paid in EURO (and in cash, unless otherwise stated) for the amount indicated on the voucher. The owner or his representative has the right to refuse access to his property if the guest does not pay the deposit. In this case, the request for compensation and / or reimbursement of rent cannot be submitted by the vacationer. The deposit will be returned to the guest upon departure, after deducting any damage and / or additional costs not included in the rental price. If a vacationer anticipates their departure, the owner or his representative is entitled to withhold the deposit and return it after checking the property and after deducting any expenses for damage and / or ancillary costs not included in the rental price. If the cost of the damage caused by the holiday guest exceeds the remaining amount of the deposit, the holiday maker is obliged to pay the difference to the owner or his representative immediately before departure. Posarelli is not responsible for any dispute between the owner and the vacationer regarding the deposit and its management.
Upon arrival, guests will find the accommodation clean and tidy. On departure, the holidaymaker must pay the final cleaning costs, unless it has been stated that these are included in the rental price. It is the customer's responsibility to ensure that the rental property is left in the same condition as it was found. All costs incurred by the owner to restore order and cleanliness due to a lack of the guest will be deducted from the deposit.
8) HEATING - AIR CONDITIONING
For properties with heating and / or air conditioning, the costs for use are specified in the property description and / or additional fees. The cost of heating and air conditioning must be paid directly by the guest to the owner or his representative and can be calculated according to consumption as shown in the description of the property under Additional Charges.
The rules for using the heating (switching on, switching off, temperature) vary from region to region. Currently, in Tuscany, as an indication and subject to changes in government regulations, it can be used from November 1st to March 30th for 8 hours per day. The possibility of turning on the heating outside of this time and the possible costs must be agreed directly with the owner of the rented accommodation.
The structures without the "symbol" for heating do not have a heating system.
Pets (dogs and cats) are only accepted in objects that are marked with the appropriate "symbol". At the time of booking, the holiday maker must inform Posarelli of any presence and number of animals, and indicate the breed and size of dogs in order to inform the owner.
The owner can demand a surcharge for pets from the guest; In this case, the amount of the surcharge is indicated in the description of the accommodation and must be paid directly on site to the owner or his representative.
In any case, the vacationer is obliged to monitor the animal in order to avoid damage or disturbance for third parties.
10) RULES OF CONDUCT
The guest who lives in a Posarelli property undertakes to behave correctly for the duration of his stay. If the behavior of the vacationer does not comply with the general rules of good behavior, the owner or his representative has the right to request the immediate removal of the guest and / or a group of guests from the property and can deduct any damage from the deposit or additional fees for any damage caused. In this case, guests cannot claim any compensation and / or reimbursement of any kind.
If the cost of the damage caused by the guest exceeds the remaining amount of the deposit, after deducting additional costs that are not included in the rental price, the guest is obliged to pay the difference to the owner or his representative immediately before departure.
It is absolutely forbidden to occupy or even stay in the villa if there are more guests than anticipated in the booking or if the number of guests is above the maximum capacity stated in the online presentation, unless the owner has Approved it beforehand. It is also strictly forbidden to organize any party, birthday party or any event without the express consent of the owner.
During the rental period, the owner or his representative reserves the right to use the property for work that is necessary for the maintenance of the garden, swimming pool or other facilities, including detached houses.
It is advisable for holidaymakers to have adequate private insurance cover for the duration of the booking.
The descriptions of the accommodations are written in good faith. Posarelli is not responsible for any changes that the owner makes to the structure without notifying Posarelli.
If a customer has a complaint about the property, Posarelli (and / or his partner Dimore) must be informed in writing on the day of arrival. The incident will be confirmed in writing and within 24 hours of arrival (the Posarelli offices are open Monday to Friday, 9:00 a.m. to 1:00 p.m. and 2:00 p.m. to 6:00 p.m. and Saturday from Easter to October from 3:00 p.m. to 7:00 p.m.)
Any complaint that is different than indicated or communicated late will not be considered.
The holiday guest must allow Posarelli the necessary time to indicate the reasons for the complaint and to find a solution, if necessary on site and in the presence of the guest and the owner or his representative.
If the complaint is justified, the guest is entitled to a reimbursement proportional to the damage suffered (always limited to the total rental price). If necessary, Posarelli reserves the right to refer the holidaymaker to another rental property that is at least the same as the property, depending on availability. If the rental price of the alternative accommodation is lower than the rental price of the booked house, Posarelli will reimburse the holidaymaker for the difference between the original price and the price of the alternative accommodation,
If the price of alternative accommodation is higher than the price booked, the holidaymaker will not be charged the difference. At the time the customer accepts the exchange, they cannot request any other type of refund.
If it is not possible to accommodate the guest in another property due to a lack of availability, Posarelli will reimburse the tenant for the rental price paid, excluding any claims for compensation and / or reimbursements of any kind. In no case will Posarelli pay hotel or other bills.
If the guest leaves the property without explaining the reason for the complaint to Posarelli or his agent, the guest loses any right to compensation and / or reimbursement of any kind.
Posarelli will not recognize any claims for compensation and / or reimbursement for disputes submitted after the end of the stay. Posarelli cannot acknowledge the causes of atmospheric events, insect bites, etc. that are typical of the place where the property is located. The presence of insects or other animals typical of the location of the property, lack of electricity, gas or water, if this is dependent on government agencies, are not grounds for complaint.
The properties offered by Posarelli are not hotel structures, but residential units and therefore do not meet the criteria of internationally recognized categories; Their equipment and decor reflect the local style, traditions (for example, the coffee machine is usually a typical moka pot and not the electric coffee machine) and the personal taste of the owner. Therefore, small deficiencies related to these characteristics cannot be regarded as grounds for a complaint.
Posarelli must be notified of cancellations in writing. Cancellation of a reservation by the guest, for whatever reason, involves the payment of the following fee:
- 25% of the total rental price if Posarelli is informed of the cancellation up to 60 days before the start of the rental.
- 50% of the total rent if the cancellation is communicated to Posarelli between the 59th and 30th day before the start of the rental.
- 90% of the total rental price if the cancellation is communicated to Posarelli between the 29th and the first day before the start of the rental.
- 100% of the total rental price if the cancellation is notified to Posarelli on the day of arrival or in case of no-show.
For some structures within the program, a cancellation policy different from the one described above is applied and you will find this in the presentation of the selected accommodation.
A fee of € 50.00 must be charged for every change made by the guest to the original booking, provided that the rental property and the rental period remain the same.
In the case of complete rebooking, the above cancellation conditions apply. The rental prices do not include insurance policies for cancellations.
If a booking has to be canceled for reasons of force majeure or for other reasons beyond Posarelli's control, Posarelli undertakes to offer the guest accommodation of the same or even higher value, depending on availability. If the rental price of the proposed replacement property is higher, Posarelli will not charge the holiday guest for this difference. If the rental price is lower, Posarelli returns the difference to the vacationer. If, for whatever reason, it was not possible to find a replacement property, Posarelli will reimburse the guest for the price of the rent. The guest has no further claims for reimbursement.
AMENDMENT to Article 14 COVID-19
For all bookings confirmed from September 15, 2020 between September 15, 2020 and December 20, 2021, the following cancellation conditions apply:
In the event of official restrictions on travel to Italy, Spain, Greece, Dubai or restrictions on travel to these countries from the traveler's country of origin during the rental period, the reservation can be canceled free of charge from 14 days before arrival (not before). In this case Posarellivillas will refund the customer the total amount paid (excluding booking fees) or provide a voucher (of the amount paid) that can be used for a future booking.
15) PLACE OF JURISDICTION
All disputes regarding reservations and terms and conditions are governed by English law and the parties accept the exclusive jurisdiction of the courts of England and Wales.
16) PROTECTION OF PERSONAL DATA
Posarelli may use personal data (as defined in the Data Protection Act 1998) for processing reservations, providing services, verifying the customer's identity, managing files and documents, complying with legal requirements and promoting services to the customer inform about relevant news. Under certain circumstances, personal data of customers can also be transmitted outside the European Economic Area (EEA) if the data protection laws may not offer the same protection as in the EEA. Customers who prefer that their data not be transferred outside of the EEA must inform Posarelli in writing. Please note that as part of the booking process we need to share information with the owners of the rental agreements. You have the right to access your personal data in our possession. If you would prefer that your personal information not be used for marketing purposes, please let us know in writing as soon as possible.
